Michael Skakel Out on Bond

The Greenwich resident has spent more than 10 years behind bars following his conviction for the 1975 murder of Martha Moxley.

On Thursday, Michael Skakel walked out of the Stamford Superior Courthouse sans cuffs but heavier one GPS tracking bracelet as he was granted a $1.2 million bond during is recently granted retrial.

Skakel, now 53 years old, spent 11 of those years a prisoner, convicted in 2002 of killing his neighbor Martha Moxley with a golf club in the exclusive Belle Haven section of Greenwich on Halloween Eve in 1975, when both were 15 years old.

Nephew to Robert F. Kennedy's widow, Ethel Kennedy, Skakel has for years levied appeals against the original decision.  Only in October of 2013 did Judge Thomas Bishop accept Skakel's April appeal. Skakel's lawyers argued he deserved a retrial due to a lack of adequate representation from his original lawyer, Greenwich's Mickey Sherman.

Conditions of Skakel's Nov. 21 release include wearing the monitoring device, not leaving the state of Connecticut and to have no contact with the Moxley family.

Dorthy and John Moxley, Martha's mother and brother, commented upon exiting the courthouse that they were disappointed in Bishop's ruling but that they stand behind the state and hope to see Bishop's decision overturned. Dorthy said Skakel is "still a convicted criminal," but believes he does not present further danger.

"I don't think he was Jeffrey Dahmer or one of those mass murderers," she said to reporters. "We don't have anything to be afraid of."

At approximately 2 p.m., Skakel appeared exiting the courthouse with his lawyer, Hubert Santos, and a number of supporters around him. They paused briefly so Santos could issue a statement before his client was ushered away to a waiting caravan, complete with police escort.
 
"There were two tragedies that occurred in Greenwich, Connecticut, in 1975," Santos said. "The first was, of course, the murder of Martha Moxley. A great tragedy for the Moxley family and for everyone else associated with them. The second great tragedy occurred in a courthouse in Norwalk, Connecticut, in 2002, when Michael was convicted of the murder of Martha Moxley—a murder he did not commit. Hopefully, we are at the first step of righting that wrong and making sure that an innocent man now goes free."

After Skakel was on the road, Dantos briefly addressed the media further, stating his client was "wonderfully happy." When asked what Skakel's first words were upon being released, he said, "Thank God."

"Michael was full of disappointment from the beginning after his prosecution," Santos said. "He was never fully confident this day would come. A great burden has been lifted off his shoulders. He desperately wanted to be home for Thanksgiving."

Wow. This is stunning news. Skakel absolutely did not receive a fair trial. It's impossible to read RFK Jr.'s Atlantic Monthly essay about the case and believe justice was served, in addition to recent revelations about Skakel's legal representation: http://www.theatlantic.com/magazine/archive/2003/01/a-miscarriage-of-justice/304759/

I absolutely agree. While I feel nothing but compassion for the Moxley's, like him or not, Michael Skakel did not get a fair trial...in SO many ways. He was convicted more on a collective disgust of the "rich" getting away with crimes, and more specifically, being at all related to the Kennedy's. From the start, not being tried as a juvenile, to allowing testimony of a deceased heroin addict who was high when he did testify, this trial was completely unfair. And that's not even mentioning the terrible council he had in Mickey Sherman...He is technically NOT a "convicted criminal" as the judge threw out his conviction. So we need to put emotions aside, and let the law and justice work as they were intended, and let him have a fair trial, as is our right as Americans.

This reminds me of all the other recent murder convictions I've read about. They also had tremendously high paid TEAMS of lawyers. They had UNLIMITED resources to aid their defense. Even with all this assistance they were unfortunately convicted anyway (alas!) But these people were able to get THEIR convictions overturned. Apparently their TEAMS of lawyers and UNLIMITED defense resources were completely incompetent. So all the rest of the murderers who were wrongly convicted because their incompetent defense team petitioned the court for a new trial. Don't you remember seeing their press conference on the steps of City Hall? oh...wait. Give me a break, this guy is guilty as sin and got out because he's a rich, spoiled Kennedy.

Rich (Kennedy) guy avoids arrest for years. Rich (Kennedy) guy finally gets arrested. Rich (Kennedy) guy hires best lawyers money can buy to defend him. Rich (Kennedy) guy loses anyway. Rich (Kennedy) guy claims that his defense was incompetent Somehow this rich (Kennedy) guy hired a TEAM of incompetent lawyers (hmmm) Rich (Kennedy) guy gets new trial It follows that he Rich (Kennedy) guy will get acquitted. Those poor Moxleys.

when republicans get convicted they never serve a day. take that senator in Alaska- convicted then overturned after the elections- or whats in face in Texas- the lizard faced guy. Got 10 years- never served a day as a GOP judge threw it out.

a lot of kennedys have gotten out of trouble... how about teddy kennedy? in a drunken state he drove off a bridge. he got out of the car but maary jo did not. he got home and didnt report till that morning instead of reporting right away which could have saved her. i have a bumper sticker that reads----more people have died in ted kennedys than in nuclear power plants. he did get punished though... his drivers license was suspended for a year.

There was DNA evidence, and a lot of cover ups alright. Only, those happend when the murder was being investigated. The DNA was not a problem back then, but did become one for Skakel once he went on trial. That said, if the trial took place back in the '70's when it SHOULD have, Skankel was 15 - he probably would have had great attorneys, and spent LESS than 10 years in jail. I would say justice was served. My heart still goes out to the Moxley family. I would hope they can find peace with the fact that he did spend 10 years in jail. By the way, he is the nephew of Ethel Kennedy's side of the family. She was a Kennedy in law. Although Skakel's family has money he is NOT a Kennedy by blood, or name.

Tony, this guy is NO blood relative to the Kennedys at all. Thisis one of the reason he got ramroded into being triednas an adukt when this haooened when he was 15 and railroaded right into prison. II want to see this DNA they have tested..ooops ther eis NO DNA, so some heroin addcit testifues while fying high in the stuff and people actually believed HIM? This is the crap he was convicted on? That wasnt a trial it ws a lynching and there are a few other guys they had in mind too before they settled on this guy. They have NO idea who killed the poor girl yet they went ennie meenie minee moe and took this guy. BS. If they dint have soe evidence it shoud never have ever got inthe court room

The Kennedys think they can get away with anything. The one that had sex with the underage babysitter. Michael Smith Kennedy with the rape. Ted Kennedy with the bridge. Even Joe with the firecrackers. Old Teds license had expired when his car went off the bridge and miraculously was renewed and backdated only to have it taken from him as punishment for his dastardly deed. Teds kid Patrick trying to push his way past a TSA agent . Arrogant bunch they are.

We have no justice in this country any more an yet look down at other country's for there abuse.. Italy example...Did anyone help me from being abused by the police, NO I'M WHITE AND MIDDLE CLASS, I was abused for years and followed around and stalked non stop once I took them to court... Abused by Fayette County Police department, Michael Delaney, Michael Sweeney, Chief of Police, Mayor Basslear State Courts or Federal court can be purchased for the right price. Attys that are being bought off for appointed positions without election.. We have a major problem with our courts today. 1986 a middle class widow, no drug, no alcohol or no criminal problems just a concussion from a auto accident 4 days earlier, in my own home, in bed. Groggy and slurred speech so I was abused and taken to two hosp and thrown into jail STRIPPED SEARCHED someone that had done ZERO ZERO. Both hospitals told the police that I had done nothing wrong..I had a concussion... But in our country today that means nothing..I was abused by the Lexington Ky police department. I have extreme PTSD due to. 1st atty ???? forgot witness list and most forgotten in paperwork. He had told me we had to take to FEDERAL court and couldn't be bought off HA HA HA. He walked off the case 20 days before trial. GUESS what he became COUNTY ATTY (1988)with no election..2nd atty Tim Philpot, thought GOD and Christ was going to do the trial for him, he knew nothing of my case. He became a KY STATE SENATOR (1990) the day of my appeal couldn't get a word out. Made no sense in appeals court. Boyfriend that started this, called police as my speech was slurred and I was groggy in my own mint condition home, in BED. He told the police in his deposition "how to break in to my home"..why was this asked? Lexiington Police broke in twice. He was given a FULL ENGINEERING PROFESSORSHIP, engineering, John Lilly.. Whole case was purchased.. The jury was also tampered with, two of the jurors came out and told us this. We went to the Federal judge and he refused to do anything, I lost and the police won.. Dishonest but this is the US so that doesn't matter. I reported this and all the transcripts to the Frankford KY, Bar Association, they said it was not unethical BUT MAL PRACTICE. Attys want $100,000 down payment to prove the fraud but what middle class person can afford this. So the Lexington Ky police got away with abusing a young widow, RN. The legal profession needs to help the public that's atty hurt them. But as with the police the legal profession protects their own... At least the Kennedy's/Smith's have the money but he was still in jail for over 10 years. Kennedy/Smith have your family put out some money to protect middle class abused people. Rich can afford and poor get for free help. Middle Class gets nothing.. I went to OPRAY and she had no interest I was not black. Jury has no idea what they are doing and the judges are political porns. . Elections of Judges is nothing more than POLITICAL and public has no knowledge of these judges behavior and once they do it's to late. The USA has no justice system left.....Legal Malpractice the public should get FREE...BAR ASSOCIATIONS DO NOTHING TO PROTECT THE PUBLIC..Not unethical so there is nothing they can do.. Kennedy/Smith God be with you,the courts are not going to protect you and the State doesn't care other than to win.... My family started this country, Mayflower John Tilley and John Howland, Josiah Barlett, 2nd signer of declaration of independence The media is not interested in stories like this abuse.. "Nope" on all counts, Tom. It's got nothing to do Liberal or Conservative political philosophy. It has EVERYTHING to do with money and influence. Back in 1975 this guy got preferential treatment because of Kennedy money and fame. In 2000, he hired a team of fabulous lawyers - and lost anyway. I don't know for sure, but I'll bet you a beer that Kennedy money and influence helped there, also. Now he's saying that all these really expensive attorneys were 'incompetent' and he deserves a new trial. AND HE GOT OUT OF JAIL!!! If you think he isn't getting preferential treatment on that claim....I have a bridge to sell you! Oh and by the way, the guy on TV news pleading his case (before his release) wasn't a Skakel, it was a Kennedy. You can't tell me there isn't a Camelot halo over this 'gentleman.'

This is one more example of the wealth and influential getting out of jail in this country. Without Kennedy lobbying for him, this individual would stay in jail
