The attorney for Michael De Maio says his client should have a psychiatric evaluation and may need medication.

The public defender for the husband accused of bludgeoning his wife with a baseball bat earlier this month, is seeking psychiatric evaluation and treatment for his client, according to a published report.

In appearance in state Superior Court in Stamford Sept. 18, attorney Howard Ehring made the request to transfer 55-year-old Michael De Maio from the Bridgeport Correction Center where he is being held on $1 million bond to the Garner Correctional Institute in Newtown, according to a report in Greenwich Time.

De Maio was arrested Sept. 10 following a baseball bat attack on his wife Diane who remains in a coma at an undisclosed hospital with critical head injuries. The attack took place in the couple's multi-million estate at 261 Round Hill Rd. Diane De Maio was seeking a divorce.

According to the newspaper report, Ehring said he wants a psychiatric evaluation for his client who has psychiatric and mental issues and may need medication.

The Garner Correctional Institution provides "care and treatment for adult male offenders with significant mental health issues ... at this level 4 high-security facility," according to the Connecticut Department of Correction website.

De Maio's case was continued until Oct. 23.
